If this happens, we will contact you as soon as reasonably practicable to offer a suitable alternative, advise of any delay or provide a full refund where applicable.
We reserve the right to discontinue any product or amend product specifications without prior notice.
6. Placing an Order

All prices displayed on our website are shown in Pounds Sterling (£).
Unless otherwise stated, prices include VAT where applicable.
Delivery charges will be shown during checkout before payment is completed.
Although we take great care to ensure pricing is accurate, genuine pricing errors may occasionally occur. Where this happens, we reserve the right to cancel an order before dispatch and will contact you to offer the option of proceeding at the correct price or receiving a full refund.

Payment must be received and authorised before goods are dispatched.
We use secure third-party payment providers to process transactions and do not store your full payment card details.
8.1 Where you create an account with GypsumTools, you are responsible for maintaining the confidentiality of your account details and password.
You agree to ensure that all information provided is accurate and kept up to date.
You are responsible for all activity carried out using your account. If you believe your account has been accessed without your permission, you should notify us immediately.
GypsumTools reserves the right to suspend or terminate any customer account where fraudulent, unlawful or abusive activity is suspected.
9. Delivery
9.1 Delivery charges are calculated based on the products ordered, delivery location and selected delivery service. Any applicable delivery charges will be clearly displayed during the checkout process before you confirm your order.
Additional delivery charges may apply to oversized, heavy, hazardous or specialist products, or to deliveries to certain postcodes or locations. Where this applies, you will be advised before your order is dispatched.
9.2 GypsumTools offers free standard UK mainland delivery on qualifying tool orders with a value of £100.00 (excluding VAT) or more.
Free delivery applies to qualifying tool purchases only and excludes certain oversized, heavy, hazardous, special-order or non-tool products where additional carriage charges may apply.
GypsumTools reserves the right to amend, withdraw or vary this promotion at any time without prior notice.
9.3 We aim to dispatch all orders promptly and will make every reasonable effort to deliver goods within the estimated delivery times displayed on our website or advised at the time of ordering.
All delivery dates and times are estimates only and are not guaranteed. Delays may occasionally occur due to circumstances beyond our reasonable control, including courier delays, adverse weather conditions, supplier shortages or other unforeseen events.
Subject to your statutory rights, GypsumTools shall not be liable for any loss or inconvenience resulting from delivery delays where we have acted reasonably and in accordance with these Terms & Conditions.
9.4 Risk in the goods passes to the customer when the goods have been delivered to the delivery address specified in the order.
Ownership of the goods shall remain with GypsumTools until payment has been received in full and in cleared funds.
Until ownership has passed, the customer must take reasonable care of the goods and must not sell, dispose of or otherwise transfer ownership of the goods unless permitted by law or agreed in writing by GypsumTools.
9.5 Please inspect your order as soon as reasonably possible upon delivery.
If your order arrives damaged, you should notify GypsumTools within 48 hours of receiving the goods. Where possible, please provide photographs of the damaged goods, packaging and delivery label to assist us in investigating the issue with our delivery partner.
Whilst we encourage customers to report damage within 48 hours, this does not affect your statutory rights where the goods are faulty, damaged or not as described.
9.6 If your order has not been delivered within the estimated delivery timescale, please contact our Customer Services team as soon as possible.
We will investigate the delivery with our courier, which may include obtaining proof of delivery, GPS tracking information and delivery photographs where available.
Where a delivery is confirmed as lost before it has been successfully delivered, GypsumTools will, at its discretion, either:

dispatch a replacement product; or
-
issue a full refund.
Claims for lost or missing deliveries should be reported to GypsumTools as soon as reasonably possible and, in any event, within 5 Working Days of the expected delivery date to enable us to investigate the matter with our delivery partner.
GypsumTools cannot accept responsibility for goods that have been successfully delivered to the delivery address provided by the customer where satisfactory proof of delivery has been obtained, except where required by applicable law.
9.7 Customers are responsible for ensuring that the delivery address and contact details provided at the time of placing an order are complete and accurate.
If an order cannot be delivered because the delivery address provided is incomplete or inaccurate, or if delivery fails because no one is available to accept the delivery where a signature is required, GypsumTools reserves the right to charge any additional delivery, redelivery or return carriage costs incurred.
9.8 If a customer refuses delivery of an order without a valid reason or fails to accept delivery resulting in the goods being returned to GypsumTools, we reserve the right to deduct any delivery charges, return carriage costs and reasonable administration costs from any refund, where permitted by law.
This clause does not apply where goods are refused because they are faulty, damaged, not as described, or where the customer is exercising their statutory rights under applicable consumer protection legislation.
10. Returns
If you wish to return goods because you have changed your mind, ordered the incorrect item, or no longer require the product, you are responsible for arranging and paying the cost of returning the goods to GypsumTools.
Unless the goods are faulty or you are exercising your statutory rights, returned items must be unused, in a resalable condition and, where reasonably possible, returned in their original packaging together with all accessories, manuals and documentation originally supplied.
Return postage, courier charges and any associated costs are the responsibility of the customer unless:

the goods are faulty.

the goods have been damaged in transit.

we have supplied the wrong item; or
-
you are entitled to a remedy under your statutory rights under applicable consumer protection legislation.
We recommend using a tracked and insured delivery service, as returned goods remain your responsibility until they have been safely received by GypsumTools.
Where goods are returned under your statutory rights because they are faulty, not as described or otherwise do not conform to the contract, GypsumTools will reimburse reasonable return postage costs or arrange collection of the goods, as appropriate.
Except where your statutory rights apply or where otherwise agreed by GypsumTools in writing, return shipping costs are non-refundable.
GypsumTools reserves the right to any refund where the value of the returned goods has been diminished as a result of handling beyond that reasonably necessary to establish the nature, characteristics and functioning of the goods, as permitted by applicable consumer legislation.
If returned goods are not collected or redelivery is not arranged within a reasonable period after we contact the customer, GypsumTools reserves the right to charge reasonable storage costs or dispose of the goods where permitted by law.
GypsumTools does not provide free returns for unwanted goods or orders placed in error.
11. Product Warranty
Warranty periods vary depending on the product purchased.
Where applicable, the warranty period and any specific warranty conditions will be stated within the individual product description on the GypsumTools website.
Unless otherwise stated, warranties cover manufacturing defects only and do not cover damage resulting from:

accidental damage.

normal wear and tear.

incorrect installation.

failure to follow the manufacturer's instructions.

unauthorised repairs or modifications.
Where a valid warranty claim is accepted, GypsumTools will, at its discretion, repair, replace or refund the affected product in accordance with the stated warranty and your statutory rights.
11.1 Any technical advice, product recommendations, installation guidance or other information provided by GypsumTools is given in good faith and is based on the information available at the time.
It remains the customer's responsibility to ensure that products are suitable for their intended purpose and are installed, operated and maintained in accordance with the manufacturer's instructions and any applicable industry standards.
Except where required by law, GypsumTools accepts no liability for loss or damage arising from reliance on technical advice where products have not been used or installed correctly.
Warranty claims may require proof of purchase and, where requested, the return of the product for inspection before a repair, replacement or refund is authorised.
Nothing in this section limits your legal rights under the Consumer Rights Act 2015.
12. Business Customers
The provisions of this section apply to customers purchasing goods wholly or mainly for business, trade or professional purposes.
Business customers are responsible for ensuring that products ordered are suitable for their intended use and should inspect all goods promptly upon delivery.
Unless otherwise agreed in writing, payment must be made in accordance with the agreed credit terms. GypsumTools reserves the right to suspend deliveries or withdraw credit facilities where payment terms are not met.
GypsumTools reserves the right to withdraw, reduce or amend any credit facility at its sole discretion.
Title to goods shall remain with GypsumTools until payment has been received in full.
Where permitted by law, business customers are not entitled to return non-faulty goods unless agreed in writing by GypsumTools. Any accepted returns may be subject to a handling or restocking charge.
Nothing in this section affects any rights that cannot lawfully be excluded.
Unless otherwise agreed in writing, invoices are payable within the agreed credit terms.
Nothing in these Terms grants the Customer any right to market or represent themselves as an authorised GypsumTools distributor or reseller without our prior written consent.
13. Intellectual Property
All intellectual property rights in this website and its content, including text, graphics, logos, icons, photographs, videos, product descriptions, downloadable documents, software, trademarks and website design, are owned by or licensed to GypsumTools.
No content from this website may be copied, reproduced, distributed, published, modified or used for commercial purposes without the prior written consent of GypsumTools.
Unauthorised use of our intellectual property may result in legal action.
14. Website Availability
Whilst we make every effort to ensure our website is available at all times, we do not guarantee uninterrupted access.
We may suspend, withdraw or restrict access to all or part of the website for maintenance, updates or operational reasons without prior notice.
GypsumTools shall not be liable for any temporary unavailability of the website where this is outside our reasonable control or necessary to maintain the security and operation of our systems.

From time to time, GypsumTools may offer promotional discounts or discount codes.

Nothing in these Terms affects your statutory rights under applicable consumer protection legislation.
Goods supplied by GypsumTools are intended to be used in accordance with the manufacturer's instructions and for their intended purpose. GypsumTools accepts no liability for damage, injury or loss arising from misuse, incorrect installation, modification or use of products outside their intended application, except where such liability cannot lawfully be excluded.
18. Force Majeure
We shall not be liable for any delay or failure to perform our obligations where such delay or failure results from events beyond our reasonable control, including severe weather, industrial disputes, transport disruption, supplier shortages, natural disasters or government action.
We will use reasonable endeavours to minimise the effects of any such event and resume performance as soon as reasonably practicable.

These Terms & Conditions, together with our Privacy Policy, Cookie Policy and any documents expressly referred to within them, constitute the entire agreement between you and GypsumTools relating to your use of the website and any purchases made through it.
